The following are terms of a legal agreement between you, NTUC Income Insurance Co-operative Limited (“Income”) and MHC Asia Group Pte Ltd (“MHC”) (Income and MHC are collectively referred to as “we”, “us” or “our”).
By downloading, accessing, browsing or using this app/portal, you acknowledge that you have read, understood, and agree to be bound by these terms and to comply with all applicable laws and regulations.
1.2 We may modify, suspend, discontinue or restrict the use of the app/portal, any portion thereof or any content at any time with or without notice.
2.1 This app/portal is maintained by MHC.
2.2 The materials displayed in this app/portal inclusive of the information and software programmes (the "Contents"), are protected by copyright, trademark and other forms of proprietary rights. All rights, title and interest in the Contents and other intellectual property right to this app/portal are owned by, licensed to or controlled by MHC (excluding any trademark, copyright and any intellectual property rights of intellectual property rights owned by Income which can be found on the app/portal)
3.1 In order to use and access the app/portal, you are required to provide information about yourself (such as identification details) as part of the registration and e-claim process, or as part of the continued use of the app/portal. You agree that any information you give to us will always be accurate, correct and up to date.
3.2 By using this app/portal you consent to our collection and use of your personal information to allow us to provide services and features to meet your needs, and to customize and improve our services to make your experience more secure and convenient. We only collect personal information about you that we consider reasonably necessary for achieving these purposes.
3.3 By submitting a claim whether online via MHC website, or via this app/portal, or manually, you agree that the information captured into and stored in any database may be disclosed to other third parties or made available to your employer for the management of the coverage provided by your employer. We may disclose your personal information to other third parties to facilitate the processing of any claims including the settlement of claims and any necessary investigations relating to the claims under your coverage; dealing in any matters relating to the services under you insurance coverage which you have applied (including the mailing of statements, invoices, reports or notices to you, which could involve disclosure of certain personal data about you to bring about delivery of the same); and investigating fraud, misconduct, any unlawful action or omission, whether relating to your claims or any other matter relating to your insurance coverage.We may also retain and disclose your information for regulatory and audit purposes.
3.4 Accordingly, you agree and understand that you are solely responsible for all activities that occur under your account. If you are aware of any unauthorised use of your account, you agree to notify MHC immediately.
4.1 The app/portal which you use may require you to install updates from time to time. These updates are designed to improve, enhance and further develop the app/portal and may take the form of bug fixes, enhanced functions, new modules and completely new versions. You agree to receive such updates as part of your use of the app/portal. We do not guarantee that we will always update the app/portal so that it is relevant to you and/or works with your device.
5.1 Except as otherwise provided, the Contents of this app/portal shall not be reproduced, republished, uploaded, posted, transmitted or otherwise distributed in any way, without the prior written permission of us. You may not: decompile, reverse engineer, disassemble, otherwise convert or authorize any third party to decompile, reverse engineer, disassemble or otherwise convert, the app/portal to a human perceivable form, resell, rent, lease or lend the app/portal; or transfer the app/portal or this agreement to any third party.
5.2 Modification of any of the Contents or use of the Contents for any other purpose will be a violation of our copyright and other intellectual property rights. Graphics and images on this app/portal are protected by copyright and may not be reproduced or appropriated in any manner without our prior written permission.
5.3 You are not allowed to attempt to extract the source code of the app/portal, translate the app/portal into other languages, or make derivative versions.
6.1 You expressly understand and agree that your use of the app/portal is at your sole risk and that the services are provided "as is" and "as available".
6.2 In particular, we, our subsidiaries and affiliates, and it's licensors do not represent or warrant to you that:
a) Your use of the services will meet your requirements;
b) Your use of the services will be uninterrupted, timely, secure or free from error;
c) Any information obtained by you as a result of your use of the app/portal will be accurate or reliable; and
d) That defects in the operation or functionality of any software provided to you as part of the services will be corrected.
6.3 Any material downloaded or otherwise obtained through the use of the app/portal is done at your own discretion and risk and that you will be solely responsible for any damage to your device or loss of data that results from the download.
6.4 We shall not be liable for and you will indemnify us against any claims, losses, damages or expenses (inclusive of all legal costs on a full indemnity basis) howsoever caused by the use of, or the inability to use, this app/portal, including but not limited to, any failure of performance, error, omission, interruption, defect, delay in operation of transmission, computer virus, or line failure. We shall also not be liable for any damages or injury including but not limited to, special or consequential damages that result from the use of, or the inability to use, this app/portal.
7.1 We reserve all rights to deny or restrict access to this app/portal to any particular person, at any time, without ascribing any reasons whatsoever.
8.1 This App/Portal allows you to retrieve an electronic copy of your medical card (e-Card). You are required to present this e-Card, together with your Identity Card (IC) at the panel clinic in order for you to receive cashless medical treatment.
These terms and conditions shall be governed by and construed in accordance with the laws of Singapore and the Parties agree to submit any dispute rising from or in connection with these terms and conditions to the exclusive jurisdiction of the courts of Singapore.
This App/Portal may include technical inaccuracies or typographical errors. This App/Portal is provided on an “as-is” basis without warranties of any kind either expressed or implied. We disclaim any and all liability regarding the use of or the result of the use of the app/portal in terms of its correctness, accuracy, reliability, or otherwise and we do not guarantee that your use of the app/portal will be uninterrupted or error free.
Income recognises its obligations under the Personal Data Protection Act 2012 (PDPA) which include the collection, use and disclosure of personal data for the purpose for which an individual has given consent to.
The personal data collected by Income includes all personal data provided in this form, or in any document provided, or to be provided to us by you or your insured persons or from other sources, for the purpose of this insurance transaction. It includes all personal data for us to evaluate or administer this transaction.
You may not alter any of the wording in this ‘Personal data collection statement’. Any attempt to do so will be of no effect.
We may collect and use the personal data to:
(a) carry out identity checks;
(b) carry out membership or information checks;
(c) communicate on purposes relating to this transaction;
(d) decide whether to insure or continue to insure you and your insured persons;
(e) provide ongoing services and respond to your inquiries or instructions;
(f) make or obtain payments;
(g) investigate and settle claims;
(h) recover any debt owed to us;
(i) detect and prevent fraud, unlawful or improper activities;
(j) conduct research and statistical analysis;
(k) coach employees and monitor for quality assurance;
(l) reinsure risks and for reinsurance administration; and
(m) comply with all applicable laws, including reporting to regulatory and industry entities
We may disclose personal data belonging to you and your insured persons for the purposes set out in Section 1 above to these parties:
(a) your financial advisers, insurance broker, association, employer or group policyholder;
(b) medical professionals and institutions;
(c) insurers and reinsurers;
(d) local or overseas service providers to provide us with services such as printing, mail distribution, data storage, data entry, marketing and research, disaster recovery or emergency assistance services;
(e) debt collection agencies;
(f) dispute resolution parties;
(g) parties that assist us to investigate, administer and adjudicate claims;
(h) financial institutions;
(i) credit reference agencies;
(j) industry associations; and
(k) regulators, law enforcement and government agencies.
You may refuse or withdraw your consent for us to collect, use or disclose your personal data and your insured persons’ personal data by giving us reasonable notice so long as there are no legal or contractual restrictions preventing you from doing so. For example, you may withdraw your consent for your personal data to be used for marketing purposes, and this withdrawal will not affect our ability to provide you with the products and services that you asked for or have with us. But if you withdraw your consent for us to use your personal data for your insurance matters, this will affect our ability to provide you with the products and services that you asked for or have with us, including preventing us from keeping your insurance cover in force or properly assessing and processing your claim. Withdrawing such consent will require you to surrender or terminate all your policies with us.
You can request access to any personal data of yours that we have, and request to know how it is being used and disclosed for the last 12 months to the extent your right is allowed by law. If we allow you access, we may charge you a reasonable fee. You also have the right to request correction of your personal data.
